Once OSHA is informed of a workplace fatality, the agency opens an inspection, said Bernard Hauber, an assistant area director with OSHA, and comes to the workplace to conduct an onsite inspection. Hauber said the inspection includes interviews about the employee’s death, any OSHA violations that may have contributed to the death and an investigation of any other OSHA violations found by inspectors. Inspectors then make a determination as a result of the investigation and decide if any citations will be issued. Citations specifically indentify any conditions that may have led to the workplace accident and OSHA violations, as well as a specified time period for correcting the violations. Any OSHA violations could result in a fine up to a maximum of $7,000 for an initial violation or up to $70,000 for any willful, repeat violations. Fines are determined based on the severity of the violation, the probability of an accident occurring and the history of the employer, Hauber said. Any employer found to willfully violate OSHA regulations could also face misdeamonor charges, as determined by the Department of Justice.
